Tribunale di Cuneo, judgment 25 May 2024, No 347 (RG No 1754/2022)

The definition of “ultra-lightweight plastic bags” referred to in Article 218(1), letter dd-quinquies of the Legislative Decree 152/2006 makes no specification as to the shape the bags must have, nor as to whether or not they must be fitted with handles, giving precedence to the teleological approach, given that they are identified in light of their specific intended use (for hygiene purposes or supplied as primary packaging for loose foodstuffs), as well as their relative thickness. In the absence of any express regulatory specification, both bags with handles and those without must consequently be included within this category – with the consequent applicability of Article 226-ter of the Legislative Decree 152/2006 – provided they are used for hygiene purposes or supplied as primary packaging for loose foodstuffs.
