Italia, la Corte europea dei diritti dell\u2019uomo ha affrontato la persistente crisi ambientale e sanitaria nella cosiddetta Terra dei Fuochi. Il ricorso \u00e8 stato presentato da cinque associazioni e 41 individui residenti nelle province di Napoli e Caserta, i quali sostenevano che le autorit\u00e0 italiane avessero omesso di proteggerli dal diffuso fenomeno di illecito smaltimento, interramento e combustione di rifiuti pericolosi, speciali e urbani nell\u2019area.<\/em><\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">La Corte ha dichiarato ricevibili sia i ricorsi delle associazioni sia quelli degli individui, sviluppando i requisiti di ammissibilit\u00e0 relativi allo status di vittima. Essa ha ritenuto che lo Stato fosse gravato da obblighi positivi ai sensi dell\u2019articolo 2 CEDU (diritto alla vita) a protezione dei residenti da gravi rischi ambientali derivanti da fenomeni di inquinamento su larga scala, come quello riscontrato nella \u201cTerra dei Fuochi\u201d. Tali obblighi si applicano anche rispetto ad attivit\u00e0 inquinanti svolte contra ius. Pur riconoscendo l\u2019ampio margine di apprezzamento degli Stati nell\u2019affrontare problemi complessi derivanti dall\u2019inquinamento da rifiuti, la Corte ha ritenuto che le autorit\u00e0 italiane non avessero agito con la diligenza richiesta dalla gravit\u00e0 e dalla persistenza della situazione. In particolare, ha riscontrato carenze nella valutazione del fenomeno dell\u2019inquinamento, nell\u2019individuazione e nella gestione dei rischi sanitari connessi, nella prevenzione delle attivit\u00e0 illecite in materia di rifiuti e nella comunicazione dei rischi alla popolazione interessata.
