The paper tries to bring to light the great, new concept of the “circular Economy”, the so called “blue Economy”, by which the researchers are trying to fight against the traditional model, the so called model of the “brown Economy”. The basic idea of the “blue Economy” is to save row materials, and in generally goods and natural resources, also by recycling all kinds of waste. From a circular point of view there is no waste (the goal of the circular policies is zero waste) and there are no “sunset products”, no “sunset goods”, in other words with a limited cycle of life. The aim of the paper is to catch the impact of the blue Economy on the law, first of all on the law of the European Union and, of course, of the Italian legislation. In this context, it seems very important to analyse the principles and the rules of the European Union (the Treaty of Lisbon and the TFUE) to give a basic, and stronger, legitimacy to the circular policies of the Union and of the national states.
