Born as a different way of understanding the waste management cycle, circular economy law passed the boundaries of the chain, calling for wider spaces than those offered by Part IV of the Italian Environment Code. Strengthened by an explicit constitutional basis, the discipline (or, as it has been called, principle) affects a multiplicity of areas and normative texts. The study seeks to measure the effectiveness of the Italian circular strategy. To this end, it describes the supervisory and sanctioning powers following a command & control or market-based scheme; in addition, it shows how cross-sectoral disciplines, such as competition law and consumer protection, can ne indirectly applied (also) to support the green transition. Finally, the paper puts forward some conclusive proposals.
