(2024) F. de Leonardis, La rivoluzione silenziosa del principio Do no significant harm (DNSH)

The provision of the “do not significant harm” (DNSH) principle/criterion in European law marks the start of a ‘silent revolution’ that could renew not only environmental law and policies, but the entire legal system. Indeed, despite the fact that the application of the DNSH poses questions of interpretation that are still difficult to resolve, the progressive broadening of its field of application is evident: from being a guarantee of transparency for so-called ‘sustainable finance’, it has become a diriment parameter for the encouragement of so-called ‘green’ economic activities. Therefore, with the goal of the climate neutrality still not in sight, it cannot be ruled out that the path taken could in the future justify a further move towards disincentivising or banning economic activities deemed to be in conflict with the ecological conformation of the economy.
